By accessing our Website or booking any service, you agree to this Policy. If you do not agree, do not use the Website or our services.

 

1) Definitions & Scope

• “Website” means https://www.train-coach.com and any pages, forms, or subdomains we control.

• “Services” means private, in-person 1-on-1 boxing and fitness coaching provided only in Prospect Park, Brooklyn, NY and, if agreed, at your home, apartment, or building gym within roughly six (6) blocks of Prospect Park. No virtual/remote training is offered.

• “Programs” currently means the TRAIN+COACH™ 12-Week Transformation Program, offered as:

• 36 sessions (3x/week) for $2,400, or

• 48 sessions (4x/week) for $3,000.

• “Client Packet” means the documents you sign as a participant (Master Service, Booking & Liability Agreement; PAR-Q; Personal Training Agreement; Optional Media Release; Parental Assumption of Risk & Indemnification, if applicable).

• “You/Client/User” means the Website visitor and/or service participant.

 

This Policy governs your use of the Website and how we handle your information online. Your in-person participation is also governed by the Client Packet, which controls if there is any conflict regarding participation, risk, and on-site conduct.

 

2) Privacy Policy

 

2.1 Information We Collect

 

We collect only what we reasonably need to deliver safe, effective coaching and to run the business:

• Identity & Contact: name, email, phone, billing details, emergency contact.

• Training-Related Health Info: information you provide through the PAR-Q, intake forms, or while booking (e.g., prior injuries, limitations, medications you choose to disclose). We do notrequest or store full medical records.

• Transactional: program selection, number of sessions, payment status, dates scheduled and attended. Payment card details are stored by our third-party payment processor, not on our servers.

• Usage/Device: IP address, browser type, device IDs, referral URLs, pages visited, time on page, and cookie/analytics data.

• Media (Optional): photos/video/audio only if you sign the Optional Media Release.

 

2.2 How We Use Information

 

We use your information to:

• Provide and manage Services (scheduling, attendance, safety, communication).

• Process payments and send confirmations and receipts.

• Communicate logistics (session times, weather changes, meeting locations), and send policy updates.

• Send opt-in marketing messages and updates about openings or waitlists.

• Enforce our rules (e.g., cancellation and safety policies) and comply with law.

• Operate, secure, and improve the Website; detect, prevent, and address fraud or misuse.

 

Where applicable, our legal bases include contract performance, legitimate interests (service operation and security), consent (marketing/SMS/media), and legal obligation (recordkeeping).

 

2.3 Disclosures/Sharing

 

We do not sell your personal information. We share it only with:

• Service Providers: payment processors, email/SMS tools, website/hosting/analytics providers, and similar vendors who help us operate. They are bound by confidentiality and may only use data as instructed.

• Legal/Compliance: if required by law, in response to lawful requests, to protect rights/safety, or in connection with a business transfer (e.g., merger, acquisition).

 

2.4 Cookies/Tracking

 

We use cookies, pixels, and analytics to operate and improve the Website. You can block cookies in your browser; some features may not work correctly. We do not currently respond to “Do Not Track” signals.

 

2.5 Marketing; SMS/Email Consent

• We send transactional emails/SMS (application received, consultation details, schedule changes, weather updates).

• Marketing emails/SMS are opt-in. You can unsubscribe at any time using the link in the message or by contacting us.

• SMS: Message and data rates may apply. Text “STOP” to opt out of marketing texts.

 

2.6 Your Rights

 

Depending on where you live, you may have rights to:

• Access, correct, or delete your personal information.

• Request a copy (portability).

• Restrict or object to certain processing.

• Opt-out of marketing communications.

 

California (CCPA/CPRA) and other U.S. state laws may provide additional rights (right to know, delete, correct, limit sensitive data use, and opt-out of “sale/share”—we do not sell/share personal information as defined there).

2.7 Security & Retention

 

We use reasonable technical and organizational measures to protect your information. No system is 100% secure.

 

We keep information only as long as needed for Services, legal, tax, and safety obligations. Signed waivers, PAR-Q forms, and similar legal documents are kept for as long as required by law and insurance.

 

2.8 International Transfers

 

We are U.S.-based. If your information is transferred internationally by our processors, we rely on appropriate safeguards where required (e.g., standard contractual clauses).

 

2.9 Children’s Privacy

 

Our Services are not directed to children under 17. Minors may only participate with parent/guardian consent and a signed Parental Assumption of Risk form. If we learn we collected data from a child without required consent, we will delete it.

 

2.10 Changes to this Privacy Section

 

We may update this Privacy section from time to time. The “Last Updated” date will change, and material changes will be posted on the Website.

 

3) Terms & Conditions of Use

 

3.1 Eligibility; Accounts

 

You must be at least 18 years old, or a minor with parent/guardian consent, to apply for coaching. You agree to provide accurate information and to keep it current. You are responsible for the security of your account and any activity under it.

 

3.2 Services; Location; No Virtual Training 

• All Services are private, 1-on-1 boxing and fitness coaching.

• Sessions take place outdoors in Prospect Park, Brooklyn, NY, and/or, if we mutually agree, inside your home, apartment, or building gym within approximately six (6) blocks of Prospect Park.

• Location flexibility is meant to remove excuses and keep you consistent; you may alternate between park sessions and home/building-gym sessions as agreed.

• We do not offer virtual, remote, or online coaching sessions at this time.

 

3.3 Programs; Pricing; Payment

 

Current program options for new clients are:

• 36 sessions (3x/week) over approximately 12 weeks – $2,400

• 48 sessions (4x/week) over approximately 12 weeks – $3,000

 

Additional or future offerings may be added or changed at our discretion.

 

Payment & Terms

• Programs are paid in full upfront before scheduling your start date, unless we approve a written payment arrangement.

• Programs are not automatic subscriptions and do not auto-renew. If you want to roll into another 12-week block, we both must agree and confirm in writing, subject to availability.

• Prices may change for future clients at any time. Existing active clients will be given reasonable notice before any change affects a renewed program. 

3.4 HSA/FSA Payments

 

TRAIN + COACH™ may accept payments made with HSA or FSA debit cards; however, eligibility depends entirely on your individual health plan. Personal training services must be considered “medically necessary” by your provider.

 

TRAIN + COACH™ does not guarantee approval or reimbursement and does not issue refunds if a claim is denied.

 

We can provide:

• Receipts

• Program outlines

• Attendance records

• Payment confirmation

 

We cannot provide:

• Letters of Medical Necessity

• Insurance billing codes

• Medical documentation

 

Clients are solely responsible for verifying eligibility with their plan.

 

3.5 Scheduling; Cancellations; No-Show Policy

 

We keep the client roster intentionally small (6–8 active clients at a time) so your time slot matters.

• Once your program start date and weekly training frequency (3x or 4x per week) are agreed, we lock in a regular time slot for you where possible.

• Sessions are scheduled in advance and reserved specifically for you.

• Cancellation/Reschedule Window: You must cancel or reschedule at least 12 hoursbefore your session start time, or the session is forfeited and counted as used.

• Lateness: If you arrive late, your session still ends at the scheduled time. Repeated lateness may be treated as a partial or full no-show at our discretion.

• No-Shows: Repeated no-shows or last-minute cancellations may result in loss of your preferred time slot or, in serious cases, termination of your program without refund.

 

3.6 Program Duration; Expiration

• 36- and 48-session programs are designed to be completed within approximately 12 weeks.

• To allow for reasonable scheduling conflicts, illness, or travel, you have up to 14 weeksfrom your first session to use your sessions.

• Unused sessions after 14 weeks expire and are not refundable, unless we agree otherwise in writing.

 

3.7 Refund Policy

 

We want to be fair while protecting the integrity of the program and limited client spots.

 

a) Cooling-Off / Early Exit

• If, after your first two (2) sessions, you genuinely feel the program is not a fit, email us within 7 calendar days of your first session.

• We may, at our discretion, offer a partial refund of unused sessions, minus:

• The full value of all completed sessions calculated at a higher, single-session rate we set for this purpose, and

• A reasonable administrative fee to cover onboarding, planning, and the spot held for you.

 

b) After the First 7 Days

• After the initial 7-day period, all sales are final and no refunds are provided except in rare circumstances we determine in our sole discretion (for example, a serious documented medical issue that makes continued training unsafe).

• In those rare cases, we may offer a partial credit or program pause rather than a cash refund.

 

c) Missed Sessions & Scheduling

• Missed or forfeited sessions under the cancellation/no-show policy are not refundable.

• If we must cancel a session and cannot reasonably reschedule it within the program window, we will credit or extend your program accordingly.

 

We design this policy to reward commitment, protect limited spots, and remain transparent about expectations.

 

3.8 Conduct; Safety; Ejections

 

You agree to:

• Follow coaching instructions, park rules, building/home gym rules, and safety guidelines.

• Train sober (no drugs or alcohol) and disclose anything that could affect safe participation.

• Treat Coach Frank, other clients, and the environment with respect.

 

We enforce strict Non-Discrimination and Anti-Harassment standards. We may remove any client who endangers safety, behaves abusively, or repeatedly violates policies. Removal for misconduct may result in termination of the program without refund.

 

3.9 Health Representations; PAR-Q

 

By applying and participating, you confirm that:

• You have completed the PAR-Q and disclosed relevant health information.

• You either have been cleared by your physician to engage in high-intensity boxing and conditioning, or you have chosen to participate at your own risk.

• You will update us if your health, medications, or condition changes in a way that could affect training.

 

You understand that outdoor and mobile training involves variable terrain, weather, and environmental conditions.

 

3.10 No Medical Advice; Emergency Care

 

Training and content from TRAIN + COACH are not medical advice. We do not diagnose or treat medical conditions.

 

In an emergency, you authorize us to seek medical assistance on your behalf. You are responsible for any related costs.

 

3.11 Intellectual Property; License

 

All Website content, including brand name, logo, images, videos, designs, text, and training systems, is owned or licensed by TRAIN + COACH and protected by intellectual property laws.

 

You receive a limited, revocable, non-transferable license to access and use the Website for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works without our written consent.

 

3.12 User Content; Media

 

You may not upload or share unlawful, infringing, or harmful content.

 

We will only use your image, voice, or likeness in marketing materials if you have signed the Optional Media Release. If you do not sign it, we will not use your likeness for promotion.

 

3.13 Third-Party Services & Links

 

The Website may link to or integrate third-party tools (maps, email services, analytics, payment processors). We are not responsible for third-party content or policies. Review their terms and privacy policies before use.

 

3.14 Disclaimers of Warranties

 

Services and the Website are provided “as is” and “as available.” We make no guarantees or warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.

 

3.15 Limitation of Liability

 

To the fullest extent allowed by law, TRAIN + COACH, Coach Frank Spear, and our members, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages.

 

Our total liability for any claim related to the Website or Services will not exceed the greater of $100 or the amount you paid us for the specific program giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

 

3.16 Indemnification

 

You agree to defend, indemnify, and hold harmless TRAIN + COACH, Coach Frank, and our affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Website/Services, your breach of this Policy, or your violation of any law or third-party rights.

 

3.17 Dispute Resolution; Class Action Waiver 

• Governing Law & Venue: This Policy and any disputes arising from it are governed by New York law. The exclusive venue is the state and federal courts located in Kings County, NY, except for small-claims or agreed arbitration.

• Arbitration (At Our Election): We may elect binding arbitration administered by a reputable forum (e.g., AAA) in New York City under its rules. You waive any right to a jury trial and agree to bring claims only on an individual basis (no class actions or class arbitrations).

• 30-Day Opt-Out: You may opt out of the arbitration/class waiver provision by emailing privacy@train-coach.com within 30 days of first using the Website.

 

3.18 Changes; Termination

 

We may modify this Policy or any aspect of the Website at any time. Continued use after changes are posted constitutes acceptance.

 

We may suspend or terminate your access to the Website or Services if we believe you have violated this Policy, applicable law, or put others at risk.

 

3.19 Miscellaneous

 

If any part of this Policy is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign our rights and obligations as part of a business transfer. This Policy, together with the Client Packet you sign for in-person participation, forms the entire agreement regarding your use of the Website and participation in our Services.

 

4) Fitness & Medical Disclaimer

• Training Risks: Boxing, conditioning, and high-intensity training involve inherent risks, including falls, impacts, overexertion, sprains/strains, heat/cold exposure, and uneven terrain. You participate voluntarily and at your own risk.

• No Medical Advice: Information on the Website and during sessions is for educational purposes only and is not medical advice. Always consult your physician before starting or changing an exercise or nutrition program, especially if you have a medical condition, are pregnant/postpartum, or take medications affecting heart rate or blood pressure.

• Assumption of Risk & Release: By applying, booking, or participating in any program, you confirm that the Client Packet (including the Master Service, Booking & Liability Agreement) governs your participation and includes your informed consent, assumption of risk, and release of claims to the maximum extent permitted by law.

• Results Not Guaranteed: We coach hard and honestly, but no coach can guarantee specific results. Your progress depends on many factors: consistency, effort, nutrition, sleep, stress, and your health status.

• Property & Theft: Do not bring valuables you cannot keep on your person. We are not responsible for lost or stolen property.

• Weather & Environment: We may modify, pause, move, or reschedule sessions for safety (e.g., lightning, ice, extreme heat, hazardous air). Weather-related adjustments do not entitle you to refunds; see the Program and Refund Policy for how we handle rescheduling or credits.

 

5) California & U.S. State Privacy Notices

 

Notice at Collection: We collect identifiers (name, email, phone), commercial information (programs purchased, payments), internet activity (cookies/analytics), and limited health-related information you choose to provide via PAR-Q and intake questions. We do not sell or “share” your personal information as those terms are defined by the CCPA/CPRA.

 

Your Rights (CCPA/CPRA): You may have rights to know, access, correct, delete, and limit use of certain personal information, as well as to opt-out of sale/share (not applicable here). We will not discriminate against you for exercising your rights.

 

Nevada (NRS 603A): We do not sell personal information.
